Car Rental Agreement

  • This Car Rental Agreement is entered into between Company FastKlean Ltd (“Owner”) and
  • (“Renter”) (collectively the “Parties”) and outlines the retrospective rights and obligations of the Parties relating to the rental of the car.
  • 1. IDENTIFICATION OF THE RENTAL VEHICLE

  • (hereinafter referred to as “Rental Vehicle”)
  • 2. RENTAL TERM

    The term of this Car Rental Agreement runs from the date and hour of vehicle pickup as indicated just above the signature line at the bottom of this Car Rental Agreement until the return of the vehicle to Owner, and completion of all terms of this Car Rental Agreement of both Parties.

  • 3. SCOPE OF USE

    Renter will use the Rented Vehicle only for personal or routine business use, and operate the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all applicable laws relating to holding of license to operate the vehicle. Renter will not sublease the Rental Vehicle or use is as a vehicle for hire.

  • 4. RENTAL FEES

    Renter will pay to Owner rental fees for use of the Rental Vehicle as follows:

  • 5. INSURANCE

    Owner is responsible for insuring the Rented Vehicle. Owner must provide to Renter with proof of insurance that would cover damage to the Rental Vehicle at the times this Car Rental Agreement is signed, as well as personal injury to the Renter, passengers in the Rented Vehicle, and other persons of property.

  • 6. REPRESENTATIONS AND WARRANTIES

    Owner represents and warrants that to Owner’s knowledge, the Rental Vehicle is in good condition and is safe for ordinary operation of the vehicle.

    Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner. Renter warrants that the vehicle will be kept in good working condition and will settle any maintenance fees associated with the Rented Vehicle.

  • 7. RELATED CONDITIONS

    • All Drivers (Renters) who are affected by the Working Time Regulations and or Drivers Hours
    • Regulations must adhere to these regulations at all times.
    • The Renter must notify the Owner immediately of any changes to personal circumstances that may affect their ability to perform their duties.  These may include; a change to driving license, health related issues, or convictions etc.
    • If you legally cannot perform the duty, the Owner reserves the right to terminate the contract without notice.
    • If the Renter has an accident, or causes damage to third party property whilst operating the Owner’s vehicle, they must report this to the Owner as soon as possible, and in any case within 24 hours.
    • Any damage or loss of Owner property or equipment by the Renter must be reported to the Owner within 24 hours, who may record these events.
    • Drivers must carry out a walk around check at the start of a duty and record and report any defects. These include:
      • Tires
      • Water Tank
      • Oil Tank
      • Wipers
      • Any damages/scratches/dents
    • Damage to the Owner of vehicles identified at service schedules that is not deemed to be fair wear and tear will be charged to the driver of the vehicle at the time of the damage occurring.
    • If whilst operating the Owner vehicle the Renter is stopped by a law enforcement officer or DVSA, or is involved in a parking infringement or incurs a congestion charge they must report this to the Owner as soon as possible and no later than two hours after the event.
    • The Driver as the vehicle Renter is fully liable for all costs and penalties incurred in consequence of traffic and order violations including also Parking and Congestion charges.
    • If the Renter is found to be using equipment, goods or property of the Owner and for personal use without permission, this will be deemed to be theft and may result in dismissal.
    • All Renters must notify the Owner if they are working for another Company.
    • All Renters who operate vehicles on the public highway are required to have their driving license checked every 3 months.  The checks will be carried out in the first week of January, April, July and October.
    • Drivers are to keep their vehicles clean and tidy at all times.
    • Make sure you collect details in the event of a car accident which should include names, addresses and contact details from any drivers, passengers and witnesses. Ask the other drivers involved for their car insurance details and try to establish whether they are the registered keeper of their vehicle. If they aren’t, find out who is and make a note of their name and address.
    • Other information should also include the registration numbers of all vehicles involved, plus a note of each vehicle’s colour, make and model. The time and date of the crash. Photographs showing the positions of the vehicles involved. A description of the weather conditions, plus anything unusual you notice about the road quality or lighting. A list of damages to vehicles and a description of any injuries sustained by pedestrians, drivers and passengers.
    • In the event of a Break down an accident on the motorway, all Drivers will be responsible to pay any Highways agency fees at their own expense.
    • Any Excess of Insurance claims is to be covered by the Driver.
    • Smoking is not permitted in company vehicles. All Drivers are subject to a fine for smoking inside the company vehicles.
    • The Road Traffic Act 1988 states that drivers of road vehicles must not be under the influence of alcohol while driving, attempting to drive or when they are in charge of a vehicle.
    • Any Driver who is believed to be under the influence or in the possession of non-prescription drugs or alcohol whilst on duty will be suspended immediately.  If after a full investigation and disciplinary hearing it is believed that an employee was under the influence of or in possession of non-prescription drugs or alcohol whilst on duty they will be dismissed for reasons of gross misconduct.
    • The Drivers taking prescription or over the counter medication must inform the Owner and request advice from a GP or Pharmacist as to whether the medication or prescription being taken may affect driving ability.
  • BY TYPING MY SIGNATURE AND SENDING IT VIA THE INTERNET, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND ALL INFORMATION REQUESTED; THAT I INTEND IB-UK TO RELY UPON IT; THAT I INTEND TO BE BOUND THEREBY; AND THAT I UNDERSTAND AND AGREE THAT MY ELECTRONIC SIGNATURE IS THE EQUIVALENT OF A MANUAL WRITTEN SIGNATURE.
