  • between (1) FASTKLEAN LIMITED whose registered office is at 196 Lancaster Road, Enfield, London, EN2 0JH and
  • of
    1. Terms and Conditions of Employment
    This agreement sets out the terms and conditions of your employment with FASTKLEAN LIMITED (the Company) including those terms and conditions required by Section 1 of Employment Rights Act 1996 to be given to you in writing.
    1. Job Title and Duties
    • You are employed as a cleaning operative. Your full job description is attached to this contract. You may on occasion be asked to carry out such other duties as are reasonable, commensurate to your job description.
    • During your employment under this agreement you must perform the duties and exercise the powers which the directors of the Company may delegate to you in connection with the business of the Company.
    • Any errors that you make will need to be rectified in your own time and may for example include working an hour extra or for an additional length of time as agreed between you and the Employer for free
    1. Commencement Date and Hours of Work
    Your employment with the Company commenced on
  • , which was the date of commencement of your period of continuous employment. No period of employment with a previous employer counts towards your continuous employment with the Company.
    • This employment is not for a fixed term; however both parties agree to provide a month’s written notice should either wish to terminate this agreement.
    3.3 Your hours of employment shall vary on day to day basis.
    1. Place of work
    4.1 You will be working at clients’ premises as instructed by the Company at various sites throughout the Greater London area.
    1. Pay
    5.1 Your salary is £
  • per hour of the whole period of work agreed above.
    5.2 You will be paid by bank transfer in arrear on the 10th of each Month. 5.3 The Company may deduct from your salary the following:
    (a) Any sum due in compensation for losses sustained in relation to the property or money of the Company, of any client, customer, visitor or other employee of the Company if that loss was caused through your proven carelessness, negligence, recklessness, or through breach of the Company’s rules or through any proven dishonesty on your part;
    (b) A day’s or part day’s pay for each day or part day of unauthorised absence, unauthorised absence being defined as failure to attend for work at the appropriate time without notifying the Company as required of any sickness and/or obtaining appropriate certification, without obtaining prior permission for leave or other reason for unscheduled absence appropriately notified to the Company and accepted by the Company.
    • The amount of any accidental overpayment to you.
    • If you are for any reason indebted to the Company for any amount, the Company shall be entitled to make a deduction in or towards the discharge of that liability from your pay or any other money payable from the Company to you.
    1. Absences and Illness
    6.1 You must:
    (a) notify the Company or your immediate superior on every day of absence from work or as soon after it as is practicable and give reason for and expected duration of the absence; and
    (b) complete and sign a self-certification of absence document as soon as is practicable and in any event not later than on your return to work; and
    (c) send to the Company a certificate of disability by a registered medical practitioner at the end of 7 days from the start of your absence and a further certificate in each successive week of absence.
    1. Sick pay, pensions, holidays and notice of termination

    7.1 You will be entitled to have 4 weeks’ paid holiday during the year, plus the 8 statutory bank holidays. If you work part time, this will be pro rata to your hours.

    7.2 The Company may refuse holiday you request if it is not convenient to the Company. You should not therefore make arrangements for holidays until such time as holiday leave is agreed with the Company.

    7.3 Holiday entitlement unused at the end of the holiday year cannot be carried over into the next holiday year.

    7.4 In the first and final year of service, entitlement to holidays will be on a pro rata basis.

    7.5 You will be entitled of  amount of Statutory Sick Pay if less, should you require a day off through illness PROVIDED ALWAYS that condition 6 is adhered to. This includes your entitlement to Statutory Sick Pay if so entitled.

    7.6 You will give the Company one month’s notice in writing should you wish to terminate this agreement.

    7.7 The Company will give you one month’s notice in writing should it wish to terminate this agreement. If you have been employed for 5 complete years or more, the Company will give you one week’s notice for each complete year of service, subject to a maximum of 12 weeks.

    7.8 There is no entitlement to pensions benefit, however, the Company shall provide access to a designated stakeholder pension scheme as required by law. The Company does not make any contributions to such stakeholder scheme.

    1. Conflicts of Interest and Confidentiality
    8.1 You must use your best endeavours to prevent the disclosure of any confidential information.
    • You agree not to retain any separate record of information during the course of provision of your service to the Company. Breach of this condition or the condition regarding confidentiality the Company will be considered Gross Misconduct and may result in your dismissal.
    • For the period of 6 months immediately following the termination of your employment, you shall not (without the previous consent in writing of the Company and whether on your own account or for any other person, firm, company or organisation) negotiate with, solicit business from, or endeavour to entice away from the Company any person, firm, company or organisation who or which is and has been a customer of the Company within the 12 months prior to the termination of your employment, in the habit of dealing with the Company or in respect of which the Company has formally tendered for work and with whom or which you had, during the course of your employment, direct dealings or personal contact during the 12 months prior to the termination of your employment, so as to harm the goodwill of, or so as to compete with, the Company.
    1. Personal Relationships in the Work Environment
    9.1 The Company expects employees to behave responsibly in the work environment. If employees are involved in a personal relationship they should conduct themselves responsibly in terms of that relationship when within the work place. Failure to do so will be regarded as a disciplinary matter.
    1. Disciplinary rules and procedure
    10.1 You are referred to the current edition of the disciplinary procedure. The procedure is revised by the directors of Fastklean Ltd from time to time. You will be notified when any changes are made.
    1. Grievance Procedure
    11.1 If you have any questions or grievances relating to your Employment you should consult the Grievance Procedure, which advises to whom such Grievances should be raised. The procedure is revised by the directors of Fastklean Ltd from time to time. You will be notified when any changes are made.
    1. Health and Safety

    12.1 It is the duty of every employee while at work to take reasonable care for the health and safety themselves and any other persons who may be reasonably affected by his or her acts and omissions at work.

    12.2 It is the duty of the Company to ensure, as far as is reasonably practicable, the health, safety and welfare at work of its employees. This duty extends to employees throughout the time when they are in the course of their employment, but not otherwise.

    1. Discrimination
    13.1 An employer may not discriminate directly or indirectly on the grounds of sex, race, disability, sexual orientation, religion/belief or age as to the terms of employment. Please see our Equal Opportunities Policy for more details.
    1. Changes
    14.1 The Company reserves the right to make reasonable changes to these and any other agreed terms and conditions of your employment.
    1. Law of Agreement

    15.1 This Agreement shall be governed by and construed in accordance with the laws of England.

    15.2 The parties to this agreement submit to the (exclusive) jurisdiction of the English courts.

    15.3 This agreement contains the entire understanding between the parties and supersedes all previous agreements and arrangements (if any).

    1. Collective Agreements
    16.1 There are no collective agreements which directly affect the terms and conditions of your employment.
